This is often the first question we are asked by clients when we first meet with them to discuss their personal injury claim.
Unfortunately, there is no definite or short answer.
The amount of compensation awarded varies according to the seriousness of the injury and the financial losses involved. It depends on the level of suffering and your loss of ability to carry on with normal day to day activities. Awards are based on medical evidence showing existing difficulties and those that may arise in the future as a result.
Another factor that makes up the level of compensation is financial losses suffered as a result of the accident. The aim here is to get you back where you were financially before the accident. Make sure you keep all your receipts for any expenses associated with your accident, for example prescriptions, treatment charges and travelling expenses, as these can all be claimed back from the Defendant.
Your compensation will take into account any loss of earnings since the accident or any that are predicted in the future. It can also cover adaptations to vehicles or property to account for special needs as well as the on-going cost of care.
In the case of a fatality, additional damages will be awarded for funeral expenses and compensation will be paid to any living relatives who were dependent on the deceased for their time and income.
