If you have not received a sum of money owed to you after a court judgment has been secured, you may need to ask the court to enforce the order. Unless you ask the court for enforcement, it will not happen automatically.
Options available to you
Lorrells can help you enforce a judgment using one of various options. Once we have examined your situation and the circumstances of your case, we will advise you on the course of action that is likely to be most successful.
Firstly, we must ascertain a number of factors which will determine the likelihood of you recovering your money and court costs from the Defendant. If we do not think pursuing the enforcement is viable, we will be completely honest with you and say so.
The options available to you for enforcement are:
1. Warrant of Execution - a court bailiff will be sent to collect the money
2. Attachment of Earnings Order - the money will be stopped from the Defendant's wages
3. Third Party Debt Order – the Defendant's bank or savings accounts will be frozen
4. Charging Order - the Defendant's house will be sold and the money paid to you from the proceeds of the sale
The court does not guarantee that enforcement will result in you receiving your money. A fee will normally have to be paid for any action taken and although this is added to the money owed to you by the Defendant, if your application is refused then you will not be able to recover the costs.
