Enforcement

After achieving a successful conclusion to any court action, the next step is to make sure the judgment made in your favour is converted into a payment.

In some cases an order for payment may need to be enforced by the court. Lorrells can help you enforce a judgment using one of various options:

 

  1. Warrant of Execution - a court bailiff will be sent to collect the money
  2. Attachment of Earnings Order - the money will be stopped from the Defendant's wages
  3. Third Party Debt Order – the Defendant's bank or savings accounts will be frozen
  4. Charging Order - the Defendant's house will be sold and the money paid to you from the proceeds of the sale

The court does not guarantee that enforcement will result in you receiving your money. A fee will normally have to be paid for any action taken and although this is added to the money owed to you by the Defendant, if your application is refused then you will not be able to recover the costs.
